We will make commercially reasonable efforts to process and ship orders within the timeframe stated on the Site or in your order confirmation. Any shipping or delivery dates are estimates unless expressly stated otherwise.

Delays may occur due to carrier issues, inventory issues, weather, high order volume, fraud review, or other circumstances beyond our control. FTC guidance for online sellers requires that shipment promises be based on a reasonable basis and that delays be handled appropriately.

Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our Returns / Refund Policy, which is incorporated into these Terms by reference.

We encourage you to review that policy before purchase. Return eligibility, timelines, product condition requirements, and refund timing will be described there.

Product Use and Safety

Our products are designed for training and fitness-related use only, as described on the Site. You are responsible for using all products safely, properly, and in accordance with any instructions, warnings, and common-sense safety practices.

The Atarax Insert™ is a weighted training insert designed for fitness and tactical training applications only. It is not body armor and should never be used as protective equipment. This product is not bullet resistant, not stab resistant, and not rated to provide ballistic protection of any kind.

You agree that:

• training with weighted equipment involves inherent risk

• you are responsible for determining whether the product is appropriate for your intended use

• you should inspect your gear and setup before each use

• improper use, poor fitment, misuse, modification, or failure to follow instructions may increase risk of injury or damage

Do not use the product if it appears damaged or if your vest or carrier is not suitable for the intended load.

Nothing on the Site is medical advice, training advice, or a guarantee of specific performance outcomes.

No Professional Advice

Information on the Site is provided for general informational purposes only. It is not intended as medical, physical training, rehabilitation, legal, or other professional advice. You should consult qualified professionals as appropriate for your circumstances.

Assumption of Risk; Release

To the fullest extent permitted by law, you acknowledge that use of weighted training products involves inherent risks, including the risk of discomfort, strain, injury, falls, equipment failure, and property damage. By purchasing or using our products, you voluntarily assume these risks.

To the fullest extent permitted by law, you release Atarax and its owners, officers, employees, contractors, and affiliates from claims arising out of misuse, improper fitment, improper training use, unauthorized modification, or use contrary to instructions or warnings.

Disclaimer of Warranties

To the fullest extent permitted by law, the Site and all products and content made available through it are provided on an “as is” and “as available” basis.

Except as expressly stated in a written limited warranty, if any, we disclaim all warranties, express or implied, including:

• implied warranties of merchantability

• fitness for a particular purpose

• non-infringement

• warranties arising from course of dealing or usage of trade

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that products will meet every user’s expectations or every third-party gear configuration.

Some states do not allow certain warranty disclaimers, so parts of this section may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, Atarax and its affiliates, owners, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, loss of use, business interruption, personal injury, or property damage arising out of or relating to:

• your use of or inability to use the Site

• your purchase or use of products

• product misuse or third-party gear incompatibility

• shipping delays

• errors, omissions, or inaccuracies on the Site

To the fullest extent permitted by law, our total liability for any claim relating to the Site or any product will not exceed the amount you paid to us for the specific product giving rise to the claim.

Some states do not allow certain liability limitations, so parts of this section may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Atarax and its affiliates, owners, officers, employees, contractors, and agents from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• your violation of these Terms

• your misuse of the Site or products

• your negligence or misconduct

• your violation of any law or third-party right

Intellectual Property

All content on the Site, including text, graphics, logos, icons, images, videos, product names, trademarks, service marks, and design elements, is owned by or licensed to Atarax and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, display, publish, sell, or exploit any portion of the Site or its content without our prior written permission, except as allowed by law.
